It is interesting to note that in the UK Mr Justice Munby in the now famed East Sussex Case said that “a lifting policy is most unlikely to be lawful which either on it’s face or in its application imposes a blanket proscription on lifting” even if that policy includes get out clauses for life threatening situations and even if it allows for lack of equipment availability.
Judge Maunby though has no jurisdiction in Australia.
